Gift Certificate Terms and Conditions

You may use this Certificate at the participating Schumacher Boutique location by handing it to the cashier for payment when making a purchase. This is not a credit/debit card and has no implied warranties. Gift Certificates may not be used to make online or Schumacher Showroom purchases. Schumacher is not responsible for lost, stolen or damaged Gift Certificates or any unauthorized Certificate use.

BALANCE AND REDEMPTION. An E-Gift Certificate will be issued for any unused Gift Certificate Balance. If a purchase exceeds your original Gift Certificate balance, the remaining amount must be paid with another payment method. This Gift Certificate may not be used to purchase other Gift Certificates. Gift Certificates cannot be resold, transferred for value, or redeemed for cash, except to the extent required by law.

RISK OF LOSS. Schumacher is not responsible if any Gift Certificate is lost, stolen, or destroyed, or if your Gift Certificate is used without your permission.

LIMITATION OF LIABILITY. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTIFICATE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CERTIFICATE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

DISPUTES. We and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.  We and you also agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

GENERAL TERMS. No fees apply to Gift Certificates. When you purchase, receive, or apply a Gift Certificate to your account, you agree that the laws of the State of the Schumacher Boutique location, without regard to principles of conflict of laws, will govern these terms and conditions and any dispute that may arise between you and Schumacher, and its affiliates related to your use of a Gift Certificate. We reserve the right to change these terms and conditions from time to time in our discretion. All terms and conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.
